These Terms and Conditions apply to all SwimKāpiti term-based continuous swimming lessons and form a legally binding agreement between you and Kāpiti Coast District Council. 1. Enrolment Enrolment in SwimKāpiti lessons is ongoing and will automatically continue until you request withdrawal. Lessons operate during school terms only and do not run during school holidays. Enrolment must be completed either: Online via the SwimKāpiti portal, or In person at reception with a completed direct debit authority. A valid direct debit must be established before enrolment can commence. 2. Payment 2.1 Direct Debit Lesson fees are charged fortnightly via direct debit through EziDebit. Payments are processed on a Monday and will continue automatically while enrolment remains active. One direct debit is processed per enrolled student. 2.2 Credit Balance Option Customers may choose to pre-load credit (up to one full term) onto their SwimKāpiti account. Lesson fees will be deducted from the credit balance before direct debit is used. If insufficient credit is available, payments will default to the direct debit setup. Customers are responsible for monitoring their credit balance. 2.3 Public Holidays and School Holidays Lessons that fall on public holidays are not charged. Direct debits are automatically paused during school holidays. 2.4 Fees Fees are set by Kāpiti Coast District Council and may be adjusted with a minimum of 60 days’ notice. Fees include applicable transaction costs charged by EziDebit. 2.5 Failed Payments If a payment fails: You will be notified and required to make a catch-up payment. A $5.50 failed payment fee applies (charged by EziDebit and non-refundable). If payment remains outstanding for more than 14 days, SwimKāpiti reserves the right to suspend or cancel enrolment until the account is brought up to date. The customer is liable for all costs incurred in recovering unpaid fees, including debt collection and legal costs. 3. Withdrawal To withdraw, you must provide at least 14 days’ written notice prior to your next scheduled direct debit. Withdrawal requests must be emailed to: swim@kapiticoast.govt.nz Enrolment and payment obligations continue until withdrawal is confirmed. SwimKāpiti will acknowledge withdrawal within 3 business days. 4. Missed Lessons and Credits Missed lessons are not eligible for make-up sessions. Credits will only be applied where: SwimKāpiti cancels a lesson A valid medical certificate is provided Credits: Are applied to your SwimKāpiti account Will be used against future payments Are not refundable unless specified in Section 6 5. Changes to Classes SwimKāpiti reserves the right to modify class times, instructors, or locations due to operational requirements. Where possible, at least 24 hours’ notice will be provided. If an alternative class cannot be offered, a credit will be applied. 6. Refunds Refunds are only available under the following circumstances: You are relocating خارج the Kāpiti region The participant will not return within three months At the discretion of Kāpiti Coast District Council Refund requests must be submitted via email. Proof of bank account details may be required. 7. Free Swims for Students Enrolled students may swim free at Kāpiti Coast District Council pools outside lesson times. Entry requires an access tag or check-in at reception. Standard supervision rules and facility requirements apply. Normal entry fees apply for events and structured activities. 8. Supervision and Safety Children under 8 years must be actively supervised by a caregiver aged 16 or over. “Active supervision” means maintaining constant visual contact and being able to provide immediate assistance. SwimKāpiti reserves the right to refuse participation where supervision requirements are not met. 9. Behaviour and Conduct All participants and spectators must comply with pool rules and staff instructions. SwimKāpiti reserves the right to suspend or remove any participant whose behaviour is unsafe, disruptive, or non-compliant. No refunds or credits will be provided in such cases. 10. Swim Nappies Children under 4 years, or those not toilet trained, must wear an approved aqua nappy. Standard disposable nappies are not permitted in pools. 11. Medical Information Customers must disclose any relevant medical conditions, disabilities, or additional needs prior to lessons commencing. This ensures appropriate support and safe participation. 12. Photography and Media 12.1 Personal Photography Photos or videos must not include other participants or instructors without consent. 12.2 Promotional Use By enrolling, you consent to SwimKāpiti using images or video for promotional and training purposes. You may withdraw consent at any time by notifying staff. 13. Force Majeure / Service Interruptions SwimKāpiti may cancel or modify lessons due to events beyond its control, including: Facility closures Staff shortages Health or safety risks Emergencies Where possible, a credit will be applied. Refunds are not guaranteed. 14. Privacy Personal information is collected for SwimKāpiti programme administration only. Information is managed in accordance with the Privacy Act 2020. Customers have the right to access and request correction of their personal information. 15. Council Policies All participants must comply with: SwimKāpiti policies Pool rules Kāpiti Coast District Council policies 16. Legally Binding Agreement By enrolling in SwimKāpiti lessons, you agree to these Terms and Conditions. 17. Changes to Terms and Conditions SwimKāpiti may update these Terms and Conditions from time to time. Where changes materially affect your rights, you will be given notice and the option to withdraw.
